Terms of Service

1. Agreement to Terms

Smartbee LLC ("we", "us", "our", "Company") operates LeaveTip ("Service"), a digital tipping platform for hotels. By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

LeaveTip provides a convenience service that enables users to create single-use claim codes for cash-like gratuities. The Service is designed to replicate the experience of leaving physical cash tips in hotel rooms or similar settings.

Important: LeaveTip is NOT a money transmission service, payment processor, or financial institution.

• We process payments through Stripe, a licensed payment processor
• We do not store, hold, or transmit funds
• We do not guarantee delivery of tips to any specific person
• Tips function like physical cash left in a room - first to claim receives it

3. How It Works

For Tippers (Guests):

1. You select a tip amount and pay via Stripe (Apple Pay, Google Pay, or credit card)
2. You pay the tip amount plus a convenience fee ($0.50-$1.50 based on tip amount)
3. You receive a 6-digit claim code valid for 24 hours
4. You leave the code for someone to claim (like leaving cash)

For Recipients (Staff):

1. You find a claim code left by a guest
2. You enter the code on our website
3. You connect your bank account via Plaid for payout
4. Funds are typically transferred to your account within 2-3 business days (free ACH transfer)

4. Undesignated Recipients

Critical: Tips are NOT designated to specific individuals. Like physical cash left in a room:

• Anyone with the claim code can claim the tip (first come, first served)
• We cannot verify the identity of claimants
• We do not guarantee tips reach intended recipients
• Once a tip is claimed, it cannot be reclaimed or disputed

5. Code Expiration and Refunds

• Claim codes expire 24 hours after creation
• If unclaimed, the tip amount will be automatically refunded to your payment method
• The convenience fee ($0.50-$1.50 based on tip amount) is non-refundable
• Refunds typically appear within 5-10 business days, depending on your bank

6. No Refunds After Claim

Once a tip is claimed, it cannot be refunded. This mirrors physical cash - once handed over, it cannot be taken back. We do not mediate disputes or reverse transactions.

7. User Responsibilities

Tippers must:

• Be at least 18 years old
• Provide accurate payment information
• Safeguard claim codes (sharing the code allows anyone to claim it)
• Understand that tips are non-refundable once claimed

Recipients must:

• Be at least 18 years old
• Provide valid bank account information for payouts
• Report tips as income per tax regulations
• Not abuse the service (e.g., brute-force code guessing)

8. Prohibited Uses

You may NOT use the Service to:

• Send tips to yourself or accomplices (self-dealing)
• Engage in fraudulent activities or money laundering
• Attempt to guess or brute-force claim codes
• Reverse engineer, hack, or disrupt the Service
• Use the Service for illegal purposes

Violation may result in account termination, withholding of funds, and legal action.

9. Payment Processing

• All payments are processed by Stripe, Inc., a third-party payment processor
• LeaveTip does not store credit card information
• By using the Service, you agree to Stripe's Terms of Service
• Chargebacks may result in service suspension

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTBEE LLC AND ITS OPERATORS SHALL NOT BE LIABLE FOR:

• Tips not reaching intended recipients
• Unauthorized claims of tips
• Delays in payment processing
• Loss of claim codes
• Service interruptions or errors
• Any indirect, incidental, or consequential damages

Your sole remedy is to stop using the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that:

• The Service will be uninterrupted or error-free
• Tips will be delivered to specific individuals
• Claim codes will not be compromised
• All features will function as described

12. Privacy

Your use of the Service is governed by our Privacy Policy.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service constitutes acceptance of modified Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

15. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

16. Dispute Resolution

We do not mediate disputes regarding tips. If you have a legal dispute with Smartbee LLC, you agree to resolve it through binding arbitration in Travis County, Texas, rather than in court.
